Terms of Service

Please read these terms carefully before using Evalyo. By using our platform, you agree to be bound by these Terms of Service.

1. Acceptance of Terms

By accessing or using the Evalyo platform ("Platform") available at evalyo.in, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms constitute the entire legal agreement between you and Evalyo Technologies Private Limited ("Evalyo", "we", "us", "our", "Company"). This agreement is subject to the laws of India and supersedes all prior negotiations, representations, and agreements (written or oral). Eligibility: • You must be at least 13 years of age to use the Platform • If you are under 18, you warrant that a parent or guardian has consented to these Terms and is responsible for your use • If you are between 13–18, your parent/guardian may contact us at contact@evalyo.ai to request account deletion • You represent that you have the legal capacity to enter into this binding agreement

2. Description of Service

Evalyo provides an AI-powered exam preparation platform including: • Personalised diagnostic tests for JEE Mains, NEET, and other competitive exams • Chapter-level practice sets based on past year questions (PYQs) • AI-generated performance reports with chapter accuracy, score, and rank estimates • Subscription-based access to premium features (PLUS and PRO plans) • Performance analytics and study recommendations Service Modifications: We reserve the right to modify, suspend, or discontinue any feature of the Platform at any time. For material changes, we will provide at least 14 days' notice via email or prominent platform notice. Continued use after the notice period constitutes acceptance. Performance & Availability: The Platform is provided on an "as-is" basis. While we aim for 99.5% uptime, we make no guarantees regarding: • Uninterrupted service availability • Server uptime during maintenance or upgrades • Access during force majeure events (natural disasters, pandemics, infrastructure failures, DDoS attacks) • Compatibility with all devices or browsers

3. Account Registration

Account Creation: To access most features, you must create an account. You agree to: • Provide accurate, current, and complete information during registration • Keep your account information updated • Maintain the security of your password and account credentials • Use a secure, unique password that you do not share • Enable two-factor authentication if available • Notify us immediately of any unauthorised use or security breach Account Responsibility: • You are solely responsible for all activity on your account • Evalyo is not liable for any unauthorized access unless caused by our negligence • You agree not to create multiple accounts to circumvent plan restrictions or ToS limits • We reserve the right to terminate duplicate, fraudulent, or suspicious accounts without refund Account Suspension: For minor violations, we will provide written notice and 7 days to cure the breach. For severe violations (cheating, fraud, harassment, malware), we may suspend immediately. You may appeal suspension within 30 days by emailing contact@evalyo.ai with supporting details. We will review and respond within 10 business days.

4. Subscription Plans and Billing

Available Plans: Evalyo offers three subscription plans: FREE, PLUS, and PRO. Features for each plan are detailed at evalyo.in/pricing. Paid Subscriptions (PLUS and PRO): • Subscription fees are billed in advance on a monthly or annual basis • All fees are in Indian Rupees (INR) and inclusive of GST and applicable taxes • Payments are processed via Razorpay; by subscribing you agree to Razorpay's Terms of Service • Subscriptions automatically renew unless cancelled before the renewal date • You will receive a renewal reminder email 7 days before the renewal date Billing & Payment Failures: • If a subscription payment fails, your subscription will be suspended for 7 days • During this grace period, you may retry payment through your account dashboard • After 7 days without successful payment, your account will be downgraded to FREE and paid features will be disabled • Failed payments may affect your credit history with Razorpay; contact Razorpay support for disputes Refund Policy – All Payments Are Final and Non-Refundable: Evalyo does not offer refunds under any circumstances. All payments for subscriptions are final and non-refundable, including: • Subscriptions cancelled within the first 7 days of purchase • Subscriptions cancelled after 7 days • Renewal charges or recurring payments • Partial usage of subscription periods • Changes in circumstances or dissatisfaction with the service • Technical issues or platform unavailability Once you complete a purchase, you cannot request a refund or chargeback. The only option available is to cancel your subscription, which stops future charges but does not refund past payments. There are no exceptions to this non-refundable policy. Cancellation: • You may cancel your paid subscription anytime via your account settings or by emailing support@evalyo.in • Cancellation is effective immediately; no further charges will apply after cancellation • Your account remains active on the FREE plan • Cancellation does NOT result in any refund of past payments • Your data remains accessible on your FREE plan account until you delete it

5. Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not: Academic Integrity: • Use the Platform to cheat, assist others in cheating, or gain unfair advantage in real exams • Attempt to use Platform content or strategies in ways that violate exam regulations Content & Security: • Scrape, copy, bulk download, or reproduce Platform content, questions, or reports without written permission • Reverse-engineer, decompile, disassemble, or attempt to extract the underlying AI models, algorithms, or source code • Use the Platform to develop competing products or services • Interfere with, disrupt, or compromise the security, integrity, or performance of the Platform System Abuse: • Use automated tools (bots, scripts, API crawlers) to access the Platform in ways that place unreasonable load on servers • Attempt to bypass security controls, authentication mechanisms, or rate limits • Launch denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks • Probe for vulnerabilities in the Platform without authorization Account & Conduct: • Share your account credentials with others or allow others to use your account • Create fake accounts or impersonate other users • Post, transmit, or encourage any content that is harmful, abusive, defamatory, misleading, or violates law • Harass, bully, stalk, or threaten other users or Evalyo staff • Attempt to gain unauthorized access to other users' data or accounts Enforcement: We reserve the right to investigate violations and take action including: warning, account suspension, permanent termination, legal action, or reporting to authorities. We may also pursue damages or seek injunctive relief for serious violations.

6. Intellectual Property

Ownership: All content on the Platform — including AI-generated questions, diagnostic tests, performance reports, user interface designs, logos, software, code, text, images, and graphics — is owned by or licensed to Evalyo Technologies and protected by Indian and international intellectual property laws. Past Year Questions (PYQs): • PYQ sources: Official exam papers from JEE Mains, NEET, and other public examination bodies • Our original contribution: Structuring, categorization, AI-powered tagging, analysis, and presentation • While PYQs themselves may be public domain, Evalyo's compilation, analysis, and presentation are proprietary License Grant: You are granted a limited, non-exclusive, non-transferable, revocable licence to: • Access and use the Platform for your personal, non-commercial exam preparation • View and download your own performance reports for personal study Restrictions: You may not: • Reproduce, redistribute, sublicense, sell, rent, or lease any Platform content • Create derivative works or modified versions • Use content for commercial purposes, tutoring, or coaching without explicit written permission • Share login credentials to enable others to access paid content • Mirror, frame, or embed Platform content on external websites Copyright & IP Claims: If you believe your intellectual property rights have been infringed, contact contact@evalyo.ai with: • Your name, contact information, and proof of ownership • Description of the allegedly infringing content and its location on the Platform • A statement declaring you have a good faith belief in the infringement We will review and respond within 10 business days.

7. AI-Generated Content Disclaimer

AI Usage & Limitations: Evalyo uses artificial intelligence to generate diagnostic tests, practice questions, personalized reports, and rank predictions. While we continually improve our AI models, you acknowledge and accept: Questions & Tests: • AI-generated questions are for practice purposes only • We do NOT guarantee that specific questions will appear in actual exams • Question difficulty, topics, and formats may vary from real exams • Some generated questions may contain errors or ambiguities • Evalyo is not responsible for inaccurate or misleading questions Performance Reports & Predictions: • Rank estimates and score predictions are approximations based on historical data • Predictions should NOT be relied upon as definitive forecasts of actual exam performance • Many unpredictable factors (exam difficulty, your preparation, health, etc.) affect real outcomes • Evalyo makes NO GUARANTEE regarding actual exam scores or ranks • Reports are updated as our AI improves; previous reports may not reflect current methodology Limitation of Warranty: We provide AI features "as-is" without warranties of accuracy, completeness, or fitness for any particular purpose. You use AI features at your own discretion and risk.

8. Privacy

Your use of the Platform is governed by our Privacy Policy (evalyo.in/privacy), which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Warranty Disclaimer & Limitation of Liability

Disclaimer of Warranties: TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED "AS-IS" AND "AS-AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING: • MERCHANTABILITY or fitness for a particular purpose • Title, non-infringement, or accuracy • Uninterrupted, error-free, or secure service • Compatibility with all devices, browsers, or software We do not warrant that: • All content is accurate, complete, or up-to-date • All AI-generated content is error-free or suitable for exam preparation • The Platform will meet your expectations or requirements • Bugs, errors, or vulnerabilities will not occur Limitation of Liability: UNDER NO CIRCUMSTANCES SHALL EVALYO BE LIABLE FOR: • Indirect, incidental, special, consequential, or punitive damages • Lost profits, lost revenue, lost data, lost business opportunity, or loss of goodwill • Damages arising from your use of or inability to use the Platform • Third-party claims, even if advised of the possibility of such damages Cap on Liability: Evalyo's total cumulative liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid us in the 12 months preceding the claim (minimum INR 1,000). Exceptions: Nothing in these Terms limits liability for: • Fraud or fraudulent misrepresentation • Gross negligence or willful misconduct • Death or personal injury • Any liability that cannot be limited under applicable law

10. Indemnification

User Indemnity: You agree to indemnify, defend, and hold harmless Evalyo, its officers, directors, employees, and agents from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees and court costs) arising from or related to: • Your violation of these Terms or applicable law • Your use of the Platform in unauthorized or unlawful ways • Your infringement of any third-party intellectual property, privacy, or other rights • Content you upload, post, transmit, or share via the Platform • Your violation of exam integrity rules or cheating • Claims by other users or third parties related to your conduct • Any breach of representations or warranties in these Terms This indemnity applies even if Evalyo is partially at fault, except where prohibited by law. Third-Party Claims: If a third party sues or makes a claim against Evalyo based on your actions, you will: • Provide prompt notice to contact@evalyo.ai • Cooperate fully with Evalyo's defense • Allow Evalyo to control the defense and settlement (provided it recovers from you) Evalyo's Indemnity (Limited): Evalyo will indemnify you against third-party claims that the Platform (as provided) infringes that third party's intellectual property rights, provided you: • Notify us promptly • Allow us to control the defense Our liability is limited to the amounts in Section 9.

11. Subscription Cancellation & Account Data

Subscription Cancellation: You may cancel your paid subscription (PLUS or PRO) at any time via your account settings or by emailing contact@evalyo.ai. Cancellation is effective immediately, and no further charges will apply after the cancellation date. What Happens After Cancellation: • Your account remains active on the FREE plan • You retain access to all your performance data and study history • All previously earned features remain accessible (read-only) • You can resubscribe at any time to restore paid plan features Refunds: • Subscriptions cancelled within 7 days of purchase: Pro-rated refund may apply (see Section 4) • Subscriptions cancelled after 7 days: No refund issued • We will process refunds to your original payment method within 5–10 business days Account Deletion: Account deletion is NOT currently supported. Your account will remain active on the FREE plan after subscription cancellation. If you wish to request complete removal of your personal data, you may submit a data deletion request to contact@evalyo.ai (see Privacy Policy Section 6). Data deletion is subject to: • Subscription must be cancelled • No pending disputes, refunds, or investigations • Payment history and tax records are retained per legal requirements (7 years) Data Deletion is permanent and irreversible; you will lose all performance data and study history. Evalyo-Initiated Suspension or Termination: Evalyo may suspend or terminate your access to the Platform (on any plan) if you: • Violate these Terms or acceptable use policies • Engage in fraud, cheating, or illegal activity • Attempt unauthorized access, hacking, or intrusion • Abuse platform resources with bots, scripts, or automated tools • Harass other users or violate conduct policies • Fail to comply after receiving a warning and 7-day cure period (except for severe violations, which may result in immediate suspension) Upon Suspension/Termination: • Your access to all platform features is immediately revoked • Your subscription is cancelled; no refund will be issued • Your account data may be deleted per Privacy Policy after any investigation concludes • You may appeal suspension within 30 days by contacting contact@evalyo.ai with supporting details

12. Force Majeure

Definition: "Force Majeure Event" means any unforeseen circumstance beyond the reasonable control of Evalyo, including but not limited to: • Natural disasters (earthquakes, floods, hurricanes, pandemics) • War, terrorism, civil unrest, or government action • Internet infrastructure failures or connectivity outages • Cybersecurity incidents (DDoS attacks, hacking, ransomware) not caused by Evalyo's negligence • Power outages or energy crises • Strikes, labor disputes, or supply chain disruptions Suspension of Performance: If a Force Majeure Event prevents Evalyo from providing the Platform, we will: • Notify users via email as soon as possible • Suspend service without breach of these Terms • Resume service when reasonably feasible • Extend subscription periods to account for outage duration (if the event lasts >24 hours) Limitations: • Evalyo is not liable for service interruptions due to Force Majeure Events • We are not excused from data security obligations; we remain responsible for protecting existing data • Force Majeure does not excuse payment obligations accrued before the event Duration: If a Force Majeure Event continues for >30 days, users may terminate subscriptions without penalty and receive a pro-rated refund for the outage period.

13. Governing Law, Jurisdiction & Dispute Resolution

Governing Law: These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Dispute Resolution: Before pursuing formal legal action, both parties agree to attempt good-faith resolution: Informal Resolution (30 days): • Contact contact@evalyo.ai with a detailed description of the dispute • Provide relevant account information, screenshots, and documentation • We will investigate and respond within 10 business days • You may follow up if unsatisfied; we will work toward a resolution within 30 days Arbitration (Optional): If informal resolution fails, either party may initiate binding arbitration: • Arbitration under the Arbitration and Conciliation Act, 1996 • Single arbitrator mutually agreed upon by both parties • Venue: Delhi, India (or as agreed) • Language: English • Rules: As per Indian arbitration law • Costs: Each party bears its own legal fees; arbitrator fees split equally • Either party may seek interim relief from courts if necessary (e.g., injunction against cheating) Litigation (Final Option): If arbitration is not pursued or if either party seeks interim relief: • Exclusive jurisdiction: Courts in Delhi, India • You irrevocably consent to Delhi courts' jurisdiction Exceptions to Dispute Resolution: The following may be pursued in court without arbitration: • Intellectual property infringement claims • Account suspension or termination appeals Class Actions Prohibited: You and Evalyo each agree that any dispute resolution shall proceed on an individual basis, not as a class or representative action.

14. Modifications to Terms

Updates & Amendments: We may update these Terms from time to time to reflect legal changes, operational needs, or service improvements. Notice Requirements: For material changes: • We will provide at least 14 days' notice via email to your registered account • We will display a prominent notice on the Platform • Changes will be posted at evalyo.in/terms with a new "Last updated" date Non-Material Changes: Minor clarifications or non-substantive changes may be applied immediately. Acceptance: • Your continued use of the Platform after the change effective date constitutes acceptance • If you do not agree with changes, you may terminate your account and delete your data • Disputes about whether a change is "material" will be resolved per Section 13

15. Severability, Entire Agreement & Assignment

Severability: If any provision of these Terms is held invalid, unenforceable, or illegal by a court, that provision will be: • Modified to the minimum extent necessary to be enforceable, OR • Severed from these Terms All remaining provisions remain in full force and effect. Entire Agreement: These Terms, along with our Privacy Policy and any other policies referenced herein, constitute the entire legal agreement between you and Evalyo regarding the Platform. They supersede all prior negotiations, understandings, representations, agreements, drafts, and communications (written or oral). Waiver: Our failure to enforce any provision does not constitute a waiver of that provision or our right to enforce it in the future. No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights. Assignment: You may not assign, transfer, sublicense, or sell your account, credentials, or rights under these Terms without our written consent. Any unauthorized assignment is void. Evalyo may assign these Terms to a successor entity or acquirer without notice. Upon assignment, the assignee is bound by these Terms.

16. Export Control & Sanctions

Compliance with Laws: You warrant that: • You are not located in, or ordinarily resident in, any country subject to Indian or international trade sanctions • You are not on any government's list of prohibited parties • You will not use the Platform for any activity that violates Indian law or international sanctions Restricted Use: You may not access the Platform if: • You are subject to sanctions by the Government of India, the U.S., UN, or EU • You are a designated terrorist or financial criminal • The Platform is restricted in your jurisdiction Consequence of Violation: If you violate export control or sanctions laws, your account will be immediately terminated, and we may report you to relevant authorities.

17. Children & Minors (Terms Specific)

Age Requirement: The Platform is not intended for children under 13. We do not knowingly allow users under 13 without verifiable parental consent. Minors (Ages 13–18): • Parents/guardians must consent to these Terms • Parents/guardians can request account modifications or deletion by contacting contact@evalyo.ai with proof of guardianship User Responsibilities: By creating an account, you represent that: • You are at least 13 years old, OR • You are between 13–18 and have obtained parental/guardian consent • The information you provide is accurate and complete

18. Survival of Terms

Survival: The following provisions survive termination or expiration of these Terms indefinitely: • Section 6 (Intellectual Property) • Section 9 (Warranty Disclaimer & Limitation of Liability) • Section 10 (Indemnification) • Section 13 (Governing Law & Dispute Resolution) • Section 15 (Severability, Entire Agreement & Assignment) • Section 18 (Survival of Terms) Other provisions survive only as necessary to fulfill their purpose.
